TERMS AND CONDITIONS OF USE OF THE “MYGLOBE” SERVICE
APPLICABLE AS OF 8 JULY 2019

Preamble

HAWKER is a company specialising in the recruitment of supplementary sales forces, promoters, etc., intended to be made available to its clients as part of the promotion of their products and/or services.

The service provided by HAWKER via its website www.globe-groupe.com and the “MyGlobe” mobile application aims to allow candidates to apply for assignments and to track the progress of their applications and completed missions.

Access to and use of the service provided via the website www.globe-groupe.com and the “MyGlobe” mobile application are subject to these Terms and Conditions of Use and imply the express, prior, full and complete acceptance by candidates of these terms and of HAWKER’s privacy policy.

HAWKER recommends that candidates keep a printed copy of the Terms and Conditions of Use applicable at the time of use of the services for their personal records.

Article 1 – Definitions

For the purposes of these Terms and Conditions of Use, the terms below shall have the following meanings, whether used in singular or plural:

“Advert”: means any service offer published on the Website and the Application for Candidates, containing data such as text, photographs, location, description of the services to be performed, contact details, brand concerned, etc.;

“Application”: means the “MyGlobe” mobile application provided by GLOBE enabling access to the Service and available free of charge on Apple Store, Google Store, Android and Windows. The Application, including its infrastructure and content (texts, sounds, images, videos and databases), is owned by GLOBE;

“Candidate”: means any natural person who has created an Account and a Profile in accordance with Article 5 and who (i) wishes to apply for an Advert and/or (ii) has already applied and/or (iii) has already carried out one or more Missions;

“Terms and Conditions of Use”: means these terms governing the use of the Service provided by GLOBE via the Website and/or the Application;

“Account”: means the account created by a Candidate allowing access to the Service via the Website and/or the Application, secured by an email address and password;

“GLOBE”: refers to HAWKER, a simplified joint stock company with share capital of €24,527,288, registered in the Paris Trade and Companies Register under number 831 813 977, with its registered office at 38 rue Boissière, 75116 Paris;

“Login Details”: means the email address and password allowing access to the Account;

“Mission”: means assignments carried out by Candidates for GLOBE’s clients;

“Privacy Policy”: refers to GLOBE’s privacy policy available on the Website;

“Profile”: means the Candidate’s personal pages linked to an Account, allowing them to provide information, upload documents and describe their professional background. The Profile is private and accessible only by the Candidate and GLOBE;

“Service”: means the MYGLOBE service allowing Candidates to:

create and complete their Profile;
view and apply to Adverts;
track their applications and Missions;
receive Adverts by phone and/or email;

“Website”: means the website www.globe-groupe.com;

“Smartphone”: means internet-enabled mobile phones;

“Tablet”: means touchscreen devices enabling access to applications via the internet.

Article 2 – Purpose – Enforceability

These Terms define the conditions under which Candidates may use the Service.

They are systematically brought to the attention of Candidates and apply exclusively, prevailing over any other terms unless expressly accepted by GLOBE.

IMPORTANT – NOTICE TO CANDIDATES

ANY USE OF THE SERVICE IMPLIES FULL AND PRIOR ACCEPTANCE OF THESE TERMS. BY TICKING THE BOX “I HAVE READ AND ACCEPT THE TERMS AND CONDITIONS OF USE AND THE PRIVACY POLICY OF GLOBE”, CANDIDATES AGREE TO BE BOUND BY THESE TERMS.

Article 3 – Modification of Terms

GLOBE reserves the right to modify these Terms at any time.

The applicable version is the one available online at the time of use.

If Candidates do not agree with the updated Terms, they must stop using the Service.

Continued use implies acceptance.

Article 4 – Conditions of Use

Use of the Service requires:

internet access;
a computer, smartphone or tablet;
creation of an Account and Profile.

Candidates must:

be of legal age;
have full legal capacity;
not use the Service for competitive or unlawful purposes;
not have previously had an Account deleted for breach.

Article 5 – Access to the Service

Access is available:

by phone or email;
or via the Website/Application by creating an Account and Profile.

Candidates must provide accurate and up-to-date information and must not impersonate others.

Article 6 – Use of the Service

Candidates may:

manage and update their Profile;
view and apply to Adverts;
track their applications and Missions via a dashboard.

Article 7 – Availability

The Service is available 24/7, subject to technical limitations and maintenance.

Article 8 – Interruptions

GLOBE may suspend access at any time for maintenance or technical reasons and shall not be held liable for interruptions.

Article 9 – Candidate Obligations

Candidates agree to:

provide accurate information;
comply with laws and these Terms;
not misuse or damage the Service;
not attempt hacking, fraud, or unauthorised access;
not distribute harmful content.

Article 10 – Candidate Liability

Candidates use the Service at their own risk and are responsible for their actions and data.

Article 11 – GLOBE Liability

GLOBE shall not be liable for:

indirect or direct damages;
service interruptions;
inaccuracies or loss of data.

The Service is provided “as is” without guarantee.

Article 12 – Personal Data

Personal data is processed in accordance with GDPR and applicable laws.

Candidates have rights of access, rectification, deletion, and objection.

Article 13 – Duration and Termination

The Terms apply for as long as the Candidate has an Account.

Candidates may terminate by deleting their Account.

GLOBE may terminate in case of breach.

Article 14 – Account Deletion

Candidates may delete their Account at any time.

GLOBE may suspend or delete Accounts in case of non-compliance.

Deletion is permanent.

Article 15 – Intellectual Property

All content on the Website and Application is owned by GLOBE or its partners.

Any unauthorised use is prohibited.

Article 16 – Miscellaneous

If any provision is invalid, others remain in force.

Failure to enforce a provision does not constitute waiver.

Article 17 – Governing Law – Disputes

These Terms are governed by French law.
